In June 2002, the Québec National Assembly amended the Environment Quality Act (EQA), allowing the Québec Minister of Sustainable Development, Environment and the Fight against Climate Change to elaborate a list of experts authorized to furnish the certificates targeting land protection and rehabilitation prescribed in Division IV.2.1 of the Act. The criteria for entry on the list of experts were published in the Gazette officielle of January 25, 2003.
The mechanism for managing the list of experts involves individuals with expertise in the field of contaminated lands and knowledge related to the application of Division IV.2.1 of the EQA and the Soil Protection and Rehabilitation of Contaminated Sites Policy and its related documents. Please note that the technical aspects of the Policy have been replaced by the ones in the Guide d'intervention - Protection des sols et réhabilitation des terrains contaminés (Response Guide—Soil protection and contaminated land restoration-only available in French).
To be recognized as experts, individuals must show, to Ministère du Développement durable, de l’Environnement et de la Lutte contre les changements climatiques’ satisfaction, competence in the field of contaminated land characterization and rehabilitation and knowledge related to the application of the EQA.
The competence is determined based on their academic training and experience in the area. The candidates must pass an examination testing their knowledge related to experts’ tasks and responsibilities.
